U.S. Supreme Court Upholds Birthright Citizenship

Writing for the majority, Chief Justice John Roberts reaffirmed that the Constitution’s Citizenship Clause protects children born in the United States, relying on more than a century of constitutional precedent dating back to the Supreme Court’s 1898 decision in United States v. Wong Kim Ark.
The decision is a major setback for the Trump administration’s immigration agenda and preserves the long-standing interpretation of the Fourteenth Amendment that has been in place for over 150 years.
The ruling means that children born in the United States will continue to receive U.S. citizenship at birth, with only the narrow constitutional exceptions that have long existed, such as children of foreign diplomats.
